Contract Disputes


What are contract disputes?

Contract disputes can occur just about anywhere, and about anything. A contract dispute simply means that a disagreement has developed over the content or interpretation of a contract. Such disputes can occur in employment contracts, especially with regard to non-competition clauses, or provisions related to what happens to sign on bonuses if the employment ends before a certain term, or even in the CC&R's applicable to your home or condominium.

Disputes can also occur with regard to leases of residential and commercial property and concern monetary obligations. They can include disputes arising out of a contract to buy or sell property. They can occur between joint owners of a business over how to dissolve said business, or in a myriad of other situations.

The first step in dealing with a contact dispute issue is to consult the applicable contract to determine if the contract supports your position, or the position of your adversary. Based on the answer to this questions, we can advise you the best way to proceed. When possible, we always encourage persons engaged in disputes to first try to resolve the issue without filing a lawsuit. Only if it is determined that the matter cannot be resolved short of litigation do we recommend that our clients proceed further with litigation to enforce their rights under the applicable contract.

If you are involved in a dispute over a contract, we can help you by reviewing the contract and advising you of your rights under the contact. For example, if a dispute has arisen concerning a commercial property lease for your business regarding the term of your lease, we can review the contract, and all modifications to that contract, and provide an opinion on the term of the lease. If the issue cannot be resolved through negotiations, we can also assist you in bringing a lawsuit to enforce your rights under the contact. If arbitration is called for under the contract, we can also represent you at the arbitration of the matter.
