What is toxic tort law?
Toxic tort law deals with cases
wherein a person has been harmed as a result of contact
with a toxic substance such as mold, toxic chemicals,
welding rod fumes, benzene, lead paint, or dangerous
prescription drug.
If the primary exposure occurred
at work, you may be entitled to file a workers
compensation lawsuit as against your employer. But you
should also know that the workers compensation law does
not stop you from bringing a lawsuit against the
manufacturer or distributor of the toxic substance for
your injuries.
Other common exposures include
exposure by being prescribed a drug, that is later found
to have toxic effects, such as Celebrex, Meridia,
Accutane, or Vioxx. Persons injured by exposure to such
pharmaceuticals are commonly recruited by law firms who
engage in mass litigation, filing cases with hundreds of
plaintiffs named in a single case. Other firms file
class action lawsuits on behalf of persons injured by
exposures to harmful pharmaceuticals. Jarvis Law
